RENTAL AGREEMENT

PAYMENT TERMS: Credit Cards (American Express, Discover, Mastercard, Visa), Debit Cards and PayPal are accepted.

CANCELLATION POLICY:  There are no refunds if the reservation is cancelled less than fourteen (14) days prior to the arrival date.

Because this is a private home with a private lease, there can be no credit given in case of early departure, and there will be no subletting or assignment by tenant without prior written consent. In the event that the owner removes the property from the management program or due to other circumstances the house is not available then every effort will be made to find a similar property. Owner or agent should not be liable to tenant should similar units not become available, whereby monies paid shall be refunded.

RATES: Rates, terms and applicable taxes are subject to change without notice. Should the reserved home become unavailable we reserve the right to move Guest  to a comparable property or refund the Guest the amount paid.

CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, that an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental is vacated.

 

SECURITY  DEPOSIT:

A 500€ Refundable Security Deposit  in form of a Credit Card charge/authorization is due at least 5 days before of check-in. This Damage deposit will not be used if only normal wear & tear of the property. In this case the authorization for the damage deposit will expire/be refunded

Additional charges may include but not only: unauthorized long distance telephone and TV Pay-Per-view charged, excessive cleaning fees including trash removal,  smoking and pets, late check-out charges, over occupancy, damaged beyond normal wear and tear, un-returned keys or any other breach of rental agreement. All charges not covered under the Rental Damage Protection Plan, if purchased may be included.

REDUCE  your SECURITY  DEPOSIT to 0€ by purchasing a Damage Protection Plan at only 45€.

PROPERTY PROTECTION PROGRAM (LIABILITY). Our company, including the participating rental property homeowners we represent (“we”, “our”, “us”), is an additionally-insured participant in a Property Protection Program that covers our personal liability related to losses that occur during the rental occupancy of our properties. We may charge renters a non-refundable administrative fee to defer our costs for Program participation.

The Program provides limited personal liability insurance to us, covering our liability in the event of bodily injury or property damage sustained by a guest/renter, a guest/renter’s family members or their invitees, while the guest/renter is occupying our property during a rental occupancy. Liability coverage is also provided for property damage to adjacent or neighboring structures as a result of our negligence.

Coverage is only in effect for the rental occupancy time period, and is limited to losses that occur on or at our covered rental property. Damage to property caused by uninvited guests is excluded. Guest/renters are not covered for bodily injury losses to a third party caused by a guest/renter; their liability coverage is limited specifically to damage to our property caused by a guest/renter. Property damage that we may sustain as a result of natural disasters (earthquakes, floods, hurricanes, hail damage or wind damage) or other weather-related events are not covered by the Program.

The Program covers accidental damage, so intentional act(s) resulting in damage is not covered. The Program covers accidental damage in excess of required security deposits that are collected. This Program may be excess over other insurance that you may have, if that other insurance covers losses that the Program covers.

The Program is not travel insurance, and offers no protection or reimbursement to guest/renters for trip cancellation and interruption, transportation expenses or lost/stolen baggage. This Program is not offered or available for sale directly to guests/renters.

Any damages that exceed 1,500€ will be responsibility of the guest. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of 1,500€. Certain terms and conditions apply.

The Security Deposit Protection can be purchased up to 1 day before check-in.

Please contact REIFUN directly if you do not wish to participate in this plan or assignment.

By submitting payment for this plan, you authorize and request the insurance company to pay directly REIFUN any amount payable under the terms and conditions of the Security Deposit Protection.

CHECK IN AND CHECK OUT: The rental period begins at 16.00 (4pm) on the day of arrival and terminates at 10.00 (10am) on the day of departure, unless prior arrangements have been made. Not approved Early check ins or late departures will incur an extra charge of 25€ per hour. The properties are professionally cleaned and inspected before and after each rental to ensure that all guests have a clean comfortable stay. Please be thoughtful of renters who may be checking in on the same day that you checkout. Occasionally delays may occur during peak season.

OCCUPANCY: Only those persons identified on the booking forms are authorized to use the property. any changes to the persons booked to occupy the house must be notified for insurance reasons. An overnight stay of unauthorized persons will result in the loss of full damage deposit. Further charges may apply. No sleeping on floor or on air mattresses etc. is allowed. We can arrange for a rollaway rental at an additional cost if occupancy laws allows – please inquire with us!

DAMAGE AND CLEANING ISSUES: Any damage or cleaning issues noticed upon arrival should be reported to the owner immediately. If damage or cleaning issues are not reported within 24 hours of your arrival. All general maintenance issues should also be reported so the unit can be kept in good repair. You will not incur any additional charges if the following items are adhered to:

*No damage is done to the unit or its content including the linens.

*No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units.)

*All debris, garbage and discards are placed in proper containers outside provided, including Community Dumpsters for excess trash where provided – Guest is responsible to follow the rules on Garbage Removal as per arrival information and posted in home/handbook.

*Kitchen is left in order, including: All soiled dishes are cleaned or placed in the dishwasher and dishwasher turned on, Fridge has been emptied out, no open left over food

*First Load of towels is washed and placed in dryer, dryer left running

*No excessive cleaning is necessary, cleaning fees include washing of 1 set of sheets per bed, if you use any spare sheets, please make sure they are washed or additional charges will apply

*No furniture has been moved

*There was no exceeding the maximum occupancy of the unit.

*There was no smoking or evidence of smoking in a designated non-smoking unit.

*Unit is left in overall neat condition.

*Pet friendly units show no sign of pet damage or excessive cleaning

*If the villa has a private BBQ, this needs to be cleaned by the guest. Should the BBQ not be clean at departure a fee of 50€ will be deducted from your Security Deposit.

If you experience any problems whatsoever with the vacation property during your stay, please contact us and we will do our best to rectify the matter as soon as it is practically possible.  Please note that as Florida is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. The vacation property is treated periodically as part of a pest control program, and is cleaned after each rental.

REFUNDS: No refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to): inoperable appliances, air-conditioning units, pools and/or spas. No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TVs, audio, telecoms, cable reception, computer equipment or internet access.

It will be attempted to repair or replace any items found inoperable as quick as possible, but it cannot be guaranteed that repair will be completed during your stay.

RIGHT OF ENTRY: Guest agrees that REIFUN reserves the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, deliver household items, or have a scheduled service carried out to make such repairs, alterations or improvements thereto as Reifun may deem appropriate. In the event that we need to schedule a repair or maintenance or enter the property for any reasons listed above, whenever possible Reifun and/or Owner will attempt to provide Guest with a minimum of 12 hours advance notice and attempt to perform services between 09.00 (9am) and 18.00 (6pm), 7 days a week.

The home that you are vacationing at may be listed for sale. If so, then there is a possibility that a realtor will call our office staff to request and arrange a convenient time to show the home to a potential customer.  Where this may occur during your stay we will make every effort to try and schedule a home showing so as to give you minimal disruption during your vacation.

SEVERE WEATHER: We do not refund rents or deposits lost due to cancelled or shortened stays because of weather. Departures due to inclement weather do no warrant refund of rent or deposit.

SMOKING: No smoking allowed inside the vacation home. A violation of this rule will result in a minimum 100€ deduction from you security deposit. Further charges for extra cleaning may apply.

POOL: Because there are no lifeguards or other attendants at the swimming pool, tenants are expressly responsible for the safety of themselves, members of their families, and guests using the swimming pool, and in so using or permitting to be used, specifically waive any and all liability claims. No tenant shall permit any juvenile member, elderly and persons with disabilities of this family or guests to play in or around the swimming pool without providing an attendant who is able to swim and can protect such juvenile in case of difficulty in the water. Tenant is expected to conduct himself as a guest with reasonable decorum and violent games and exercises are not permitted. Disconnecting the pool alarms is against the law.

SPA, DECK AND PATIO: Tenant hereby acknowledges that if the property they have reserved includes a swimming pool/spa (where applicable), patio and deck. The undersigned is fully aware that the surrounding areas can be dangerous and slippery when wet and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the pool, Jacuzzi, deck and patio areas. No glassware is to be taken outside to the pool area

AIR CONDITIONING: The Air Conditioning unit MUST NOT be set below 20 degrees Celsius in COOLING Mode. Failure to comply with this rule will result in the unit freezing over. The cost of having a repair man come out to fix the unit because of it freezing over will be charged to you!

PET POLICIES – NO  PETS  ALLOWED!

For Pet Friendly Units only: Guest MUST INQUIRE WITH US before confirming reservation. There is a maximum of 1 small pets allowed in each unit. Guest pets must be treated for fleas and ticks prior to arrival.

An extra PET cleaning fee of 120€ + tax applies. Accidental Damage Protection Plan and a 300€ security deposit or signed Security Deposit Authorization (credit card) is required. Guests must pick up after pets and tightly tie the remnants in a plastic bag if staying in a Pet Friendly Unit. FAILURE TO DO SO WILL RESULT IN A MINIMUM DEDUCTION OF 50€ FROM YOUR SECURITY DEPOSIT. Pets are not allowed on the furniture and all pet hair must be cleaned up prior to departure. A 150€ fee will be charged if there is any report of pet hair on bedding and sofas. Guest pets must be leashed at all times when outside of the unit. The violation of any terms of this pet policy subjects the guest to additional fines or termination of the rental period. Guest pet policies and unit availability are subject to change per county and association rules and regulations at any time.

COMMUNITY RULES: Guest agrees to abide by rules of the community (as for example: quiet times, parking rules etc…). These may be posted in the unit or at the community pool or office. These rules may change from time to time.

SPECIAL NEEDS: If you have any special needs, these must be conveyed to the agent at the time of your booking, we will make every effort to accommodate your needs, however if the request was not made at the time of booking and we are unable to provide you with what you need, you will not be entitled to any kind of refund.

If any member of your party is hearing impaired, please advise us upon booking as an additional smoke detector for the hearing impaired can be placed in the home.
